These Terms and Conditions (“Agreement”) govern the relationship between Baashad Construction Corp the company (“Company,” “we,” “our,” or “us”) and the client (“Client,” “you,” or “your”) in connection with construction, renovation, and related services.
1. Scope of Services Baashad Construction Corp agrees to provide services as detailed in the project estimate or service agreement. Any modifications or additions to the scope of work must be agreed upon in writing and may affect pricing and project timelines.
2. Billing and Invoices Estimates are provided based on current information and may be subject to change due to client modifications, material costs, or unforeseen site conditions. Invoices will be issued in accordance with the payment schedule outlined in the signed estimate or proposal. Payment Terms: A deposit is required prior to the start of work. Remaining payments are due according to the agreed project milestones or invoice schedule. Late payments may be subject to a late fee of 1.5% per month on the outstanding balance. Accepted Payment Methods: Cash, Credit card, check, Zelle.
3. Refund Policy A full refund will be issued only if: * The client cancels the service **before** any materials are purchased, and * No labor or planning work has been performed. Once materials are purchased or work has begun, only partial refunds may be considered, subject to the costs already incurred by the Company.
4. Cancellation Policy Cancellations must be submitted in writing at least **five (5) days** before the deposit payment is made. * If cancellation occurs after the deposit is received, refund eligibility will be determined based on work completed and materials purchased. * The Company reserves the right to deduct administrative or restocking fees from any refund.
5. Delays Baashad Construction Corp will make every effort to complete projects on schedule. However, delays may occur due to factors including but not limited to: * Weather conditions * Material availability * Changes requested by the client * Site accessibility or unforeseen conditions We will communicate any delays and updated timelines as they arise.
6. Client Responsibilities Clients are expected to: * Provide clear access to the job site * Respond to communications in a timely manner * Review and approve changes or invoices promptly * Notify the Company of any concerns or disputes within **5 business days** of receiving an invoice or project update
7. Modifications and Change Orders Any changes to the original agreement (scope of work, materials, layout, etc.) must be documented in a written **Change Order** and may affect the overall cost and completion date of the project.
8. Limitation of Liability Baashad Construction Corp is not liable for damages or delays caused by factors beyond our control, including but not limited to third-party vendors, acts of God, or municipal code changes after the project has begun.
9. Governing Law This Agreement shall be governed by and interpreted in accordance with the laws of the state of New York, without regard to its conflict of law principles.
10. Acceptance of Terms By engaging with Baashad Construction Corp, submitting a deposit, or approving a project estimate, the Client acknowledges and agrees to these Terms and Conditions.
